No internet poker for Morongo

The Morongo Band of Mission Indians announced on Tuesday that it will stop efforts to legalize internet poker, at least for the time being.

The Morongo Band operates the Morongo Casino Resort and Spa near Cabazon, California. A spokesman for the tribe , Patrick Dorinson, said that the decision was made after consulting with other area tribes.

Waltona Manion, speaking on behalf of California card rooms that were teaming with the Morongo tribe on the legislation, said the mutual postponement decision was made to ensure legislators and California tribes are well-informed and have a chance to vet the issue fully.

“We will be coming back at the beginning of the session to begin dialogue on this issue once again,” said Manion, a former spokesperson for the Morongo tribe.

The push by two entities that historically have been pitted against one another was revealed last month as a way to hedge a bet against illegally wagered, offshore Internet gambling operatives and the push in Congress to lift a federal ban on Internet gambling.
The premise was to form a California Tribal Intrastate Internet Poker Consortium LLC to bridge the Unlawful Internet Gambling Enforcement Act of 2006 to allow intrastate Internet poker.

Tribal leaders quietly describe the effort as highly sensitive at the moment.
“Tribal and state leaders clearly need more time to weigh the consequences of this proposal,” said Mark Macarro, tribal chairman of the Pechanga Band of Luiseño Indians in Temecula. “There may be merit to the concept, but a lot of questions still need to be addressed.”

State lawmakers are wrangling with critical issues at this time — the water crisis, budget shortfall and potential release of prison inmates.

Cheryl Schmit of Stand Up California has said operation of an online poker site off Indian land holds potential to be in violation of the Indian Gaming Regulatory Act.

Questions also have been raised over the ramifications this would have on the exclusive rights of tribes with state gaming compacts to conduct Las Vegas-styled slot machine gaming. And the impact on voter sentiment — particularly since Californians gave the nod to a major slot machine expansion in 2008.

At least three meetings of the California Nations Indian Gaming Association with tribal leadership failed to net consensus to advance legislative prospects at this time.
David Quintana, political director for the California Tribal Business Alliance, which was among the first groups representing tribal interests in California to oppose legislation, said it was good the effort has subsided because the proposed drafts underwent numerous changes.

“We think, as this moves forward, that this discussion needs to go much broader than one tribe, and a bunch of card rooms,” Quintana said. “This postponement might bring about a much broader discussion, a full and honest debate with more stakeholders taking a part in it.”

Since mid-August, Quintana said other potential network operators have come forward who may be more technologically suited to operating online poker such as affiliates to the horse racing industry.
Horse racing interests have expertise in advanced deposit wagering via satellite, Quintana said. “Their technology is much closer to it than is that of those who operate a bricks-and-mortar casino,” he noted.

For now, Dorinson said the Morongo Band will work to build a coalition.

“Clearly, this is an issue that will have to be dealt with,” he said. “The federal government is looking at this issue” because it is estimated that millions upon millions of dollars annually is lost to illegal, offshore Web sites.

“Illegal gambling is already happening in California, and we need to make sure there's regulatory protections for consumers,” Dorinson said. “We need to make sure that California gets its share of the prize.”
