Know how to hold 'em; know when to fold 'em
With the interest in high-stake poker games increasing in popularity due to a barrage of televised tournaments, the Indiana Department of Revenue and the Indiana Attorney General's Office warn that such tournaments held in Indiana are illegal unless conducted by a licensed nonprofit organization.

Indiana charity gaming is administered by the Department of Revenue and provides two different types of licenses that allow charities to conduct poker tournaments under certain restrictions.

All other poker tournaments where money is wagered or a fee is paid to participate and prizes awarded are illegal except for activity on a licensed Indiana riverboat.

The Department is seeing an increase in poker tournaments, such as Texas Hold'em.

Many are not associated with a nonprofit organization. If a nonprofit does apply for a license, the poker tournament is often being run by an individual or company that receives a percentage of the profits. Such activity is regarded as contracting, a Class D felony.

"It is easy to get wrapped up in the fun and excitement of a competitive tournament," Attorney General Steve Carter said. "But there are specific laws and regulations surrounding games of chance in Indiana that people do need to be aware of and follow. Following the law could keep you from participating in illegal activities."

According to Indiana state law, a qualified nonprofit organization holding a valid license is limited to four days a year where card games and wagering are allowed.

The events must be staffed by the nonprofit's membership and all proceeds must go to the charity.

"Gaming in Indiana is very restrictive," said State Revenue Commissioner John Eckart. "The Department's concern is that Indiana citizens are aware of and follow all applicable laws, and that charities are properly licensed."
